PENGUIN LIGHT PUBLISHING (“PLP,” “WE,” “US,” OR “OUR”) RESERVES THE RIGHT, AT OUR DISCRETION, TO CHANGE, MODIFY, ADD, OR REMOVE PORTIONS OF THESE TERMS OF USE AT ANY TIME. PLEASE CHECK THESE TERMS OF USE PERIODICALLY FOR CHANGES. YOUR CONTINUED USE OF THE SITES FOLLOWING THE POSTING OF CHANGES TO THESE TERMS OF USE WILL MEAN YOU ACCEPT THOSE CHANGES.

You may not use PLP’s name, logo, or materials to imply endorsement without express written permission.

By providing payment information, you represent that you are the authorized user of that payment method.

Data collection and use, including personal information, are governed by PLP’s Privacy Policy, which is incorporated into this Agreement.

Where PLP specifically invites user-submitted content, you grant PLP a non-exclusive, perpetual, irrevocable, royalty-free, worldwide, fully sublicensable license to use, reproduce, modify, publish, distribute, and display such content.

User Submissions must comply with all listed rules regarding intellectual property, privacy, respectful behavior, legality, and prohibited content.

PLP reserves the right to remove User Submissions at any time.

PLP has the right, but not the obligation, to monitor and remove any content that violates these Terms of Use or applicable law. PLP will cooperate with legal authorities as required.

You agree to provide accurate registration information and to maintain the confidentiality of your password and account. You are responsible for all activity under your account. Notify PLP immediately of any unauthorized access.

By using the Sites or submitting User Submissions, you represent and warrant that you:

• Are of legal age or have parental consent
• Own or have permission to use all rights in your User Submissions
• Will not violate third-party rights or any laws
• Will not submit false, harmful, defamatory, obscene, or illegal content

PLP may terminate or suspend access to the Sites at any time, without notice, for any reason. Upon termination, your obligations under these Terms survive.

If you have a dispute with another user, you release PLP and its affiliates from all claims arising from such disputes.

The Sites and all Content are provided “AS IS” without warranties of any kind. PLP does not guarantee uninterrupted service, error-free operation, or virus-free content.

To the fullest extent permitted by law, PLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Sites.

PLP’s total liability shall not exceed the amount you paid for access to the Sites or for purchased Content.

You agree to indemnify and hold PLP and its affiliates harmless from any claims, losses, or damages arising from your violation of these Terms or misuse of the Sites.

PLP shall not be liable for delays or failures due to causes beyond its reasonable control, including natural disasters, war, labor disputes, and utility failures.

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. By using the Sites, you consent to the exclusive jurisdiction of courts in Sheridan County, Wyoming.

These Terms constitute the entire agreement between you and PLP and supersede any prior agreements.

PLP respects the intellectual property rights of others. If you believe your copyrighted work has been infringed, provide written notice including:

1. Your physical or electronic signature
2. Identification of the copyrighted work
3. Identification of infringing material
4. Your contact information
5. A statement of good-faith belief that the use is unauthorized
6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act
